Unified Agenda Lists Planned Deregulatory Actions

The Trump Administration’s Unified Agenda of Regulatory and Deregulatory Actions describes the proposed and final rules that federal agencies plan to issue in the months ahead. The Fall 2017 update lists a variety of planned actions to rescind or revise regulations aimed at reducing greenhouse gas emissions. The planned actions are listed below along with relevant details. We will also update the tracker when each proposal is published in the Federal Register.

Environmental Protection Agency

• Review of the Clean Power Plan, RIN 2060-AT55. The Unified Agenda (UA) notice states that EPA will issue a proposal to withdraw the Clean Power Plan on the grounds that it exceeds the statutory authority provided under section 111 of the Clean Air Act.
• Review of the Standards of Performance for Greenhouse Gas Emissions From New, Modified, and Reconstructed Stationary Sources: Electric Generating Units, RIN 2060-AT56. The UA notice states that EPA will issue a proposal to withdraw these standards on grounds that they exceed the statutory authority provided under section 111 of the Clean Air Act.
• DOT/EPA, Passenger Car and Light Truck Corporate Average Fuel Economy Standards MYs 2022-2025, RIN 2127-AL76. The UA notice states that DOT and EPA will undertake a rulemaking to set new fuel economy standards for passenger vehicles and light trucks MYs 2022-2025.
• Final Rule: Oil and Natural Gas Sector: Emission Standards for New, Reconstructed, and Modified Sources: Extension of Stay for Certain Requirements, RIN 2060-AT59. The UA notice indicates that EPA will issue a final rule staying requirements of the Oil and Gas Sector New Source Performance Standard (NSPS) pertaining to fugitive emissions, pneumatic pumps, and professional engineer certification. The proposed rule, which was published in June 2017, would stay the requirements for the NSPS for two years.
• Protection of Stratospheric Ozone: Revisions to the Refrigerant Management Requirements under the Clean Air Act: The UA notice states that EPA will revisit aspects of a 2016 rule that extends refrigerant management requirements to substitutes like hydrofluorocarbons.

Department of Interior

• Proposed Rule: Revision or Rescission of the 2016 Waste Prevention, Production Subject to Royalties, and Resource Conservation Rule (Methane Waste Rule), RIN 1004-AE53. The UA notice does not specify whether the Methane Waste Rule will be revised or rescinded or otherwise discuss the content of the rule.
• Proposed Rule: Waste Prevention, Production Subject to Royalties, and Resource Conservation (Methane Waste Rule); Delay and Suspension of Implementation Dates for Certain Requirements, RIN 1004-AE54. The UA notice specifies that the proposed rule would suspend key provisions pertaining to methane waste minimization and capture until July 2019.
